This Policy defines how the Nuvia Platform may and may not be used. It forms part of the Terms of Use and applies to all Customers and Users.
1. Authorized Use Cases
The Platform may be used exclusively for:
- sales qualification and handling of inbound leads who have made contact or expressed interest;
- customer service and support for the Customer's own customers;
- business-to-business (B2B) outbound sales prospecting, under the conditions set out in section 2.
Any other use case requires prior approval, as set out in section 7. Use of the Platform for an unauthorized use case constitutes a breach of the Terms of Use.
2. Rules for Outbound Prospecting
2.1 Outbound prospecting is permitted exclusively between businesses. Contacts must be professionals approached in their professional capacity, on a matter relevant to their role and to the company they work for.
2.2 The Customer must direct the contact to the person best qualified for the matter at the target company, limiting the number of people approached to what is necessary for the business purpose.
2.3 The use of personal data of individuals in outbound prospecting is prohibited, including CPF (Brazilian individual taxpayer number), personal phone number or personal email, income and socioeconomic data.
2.4 The Customer must be able to justify, upon request, why each person was selected for contact.
3. Rules for Data Enrichment
3.1 Data enrichment must be relevant and proportionate to the authorized use case and the declared purpose, limited to the data necessary for that purpose.
3.2 Enriching data about people unrelated to the declared business purpose, or for personal, investigative or individual monitoring purposes, is prohibited.
3.3 Enrichment features involving data of individuals are only enabled for use cases approved by Nuvia, and only where there is an appropriate legal basis, such as the Data Subject's consent or a prior relationship with them.
3.4 Data obtained through enrichment is for the exclusive use of the Customer who requested it, for the declared purpose.
4. Prohibited Uses
The Platform may not be used for:
- electoral advertising or party-political communication;
- active offering of payroll-deductible loans (crédito consignado) to INSS (Brazilian National Social Security Institute) beneficiaries;
- patient acquisition or the offering of healthcare procedures;
- client solicitation for activities restricted to licensed attorneys;
- promotion of betting, gambling and high-risk assets;
- debt collection that involves third parties, takes place outside permitted hours or exceeds the frequency set by law;
- contacting a Data Subject who has objected or requested the deletion of their data;
- contact directed at persons under 18 years of age;
- sending unsolicited mass communications or communications that breach channel policies;
- misleading, fraudulent, discriminatory, defamatory or unlawful content;
- misrepresentation of identity, of a company or of an affiliation with third parties;
- processing of sensitive personal data without a specific legal basis;
- any activity that violates applicable law or the rights of third parties.
5. Data Origin and Purpose
5.1 The Customer shall declare, upon contracting and whenever it uploads new databases, the purpose of the processing and the lawful origin of the data, and is liable for the accuracy of such declarations.
5.2 Uploading databases acquired from third parties without demonstration of lawful origin, obtained through data scraping, or whose origin the Customer cannot demonstrate is prohibited.
5.3 Nuvia may request proof of the origin of the data and suspend its use until such proof is provided.
6. Transparency and Objection
6.1 Every contact made through the Platform must identify the company on whose behalf it is made and offer the Data Subject a means to object to further contact.
6.2 The Customer must immediately honor objection requests and maintain a suppression list, refraining from contacting again anyone who has objected.
6.3 The Customer shall not disable or alter the transparency elements provided by the Platform.
7. Approval of New Use Cases
7.1 A Customer wishing to use the Platform for a use case not listed in section 1 must request approval from its Customer Success contact, describing the purpose, the audience, the origin of the data and the legal basis.
7.2 The request is assessed by Nuvia, and the use may only begin after express written approval. Nuvia may make approval conditional on additional safeguards or deny it.
7.3 New uses within an already authorized use case do not require new approval, provided they comply with this Policy.
8. Monitoring and Enforcement
8.1 Nuvia may monitor Platform usage indicators to verify compliance with this Policy.
8.2 In the event of a breach or reasonable suspicion of one, Nuvia may request clarification, restrict features, suspend campaigns or access, and terminate the contract, in accordance with the Terms of Use.
8.3 Violations may be reported to security@nuvia.ai.
9. Updates
This Policy is updated whenever new use cases are incorporated into the Platform or there is a change in the law or in channel policies. The current version is available at nuvia.ai/en/politica-de-uso-aceitavel.
